Firearm Transfer Information All firearm transfers will be processed through an authorized FFL dealer. A $35 transfer fee will be added to your invoice for every three (3) firearms purchased. For example: 1–3 firearms: $35 transfer fee 4–6 firearms: $70 transfer fee 7–9 firearms: $105 transfer fee All buyers must comply with all applicable federal, state, and local firearm laws in their state of residence. Buyers must be 21 years of age or older to purchase any firearm offered in this auction. All out-of-state firearm purchases must be shipped to a licensed FFL dealer in the buyer's home state. All shipping, transfer, and related expenses are the responsibility of the buyer. FFL transfers for local buyers will be completed on-site. Firearms & Ammunition Terms and Conditions All firearms transfers shall be conducted exclusively through an authorized Federal Firearms License ("FFL") dealer in accordance with all applicable federal, state, and local laws. Purchasers are solely responsible for ensuring they are legally eligible to purchase, possess, own, and receive any firearm or ammunition purchased through this auction. By placing a bid, the bidder represents and warrants that they are not prohibited by law from purchasing or possessing firearms or ammunition. All firearm purchasers must successfully complete all required ATF paperwork and pass the National Instant Criminal Background Check System (NICS) background check, unless otherwise exempt under applicable law. Failure to successfully complete the transfer for any reason, including denial or delay by NICS, failure to provide required documentation, inability to legally possess the firearm, or failure to complete the transfer within the required timeframe, shall not relieve the purchaser of any obligations under these Terms and Conditions. In such event, the purchaser may forfeit any payments made and may be subject to any applicable resale, storage, administrative, or other fees as permitted by law and the auction terms. Purchasers must present a valid government-issued photo identification and any additional documentation required by law at the time of transfer. Transfer fees are $35.00 for every three (3) firearms purchased and will be added to the purchaser's invoice. All out-of-state firearm purchases must be shipped to a licensed FFL dealer selected by the purchaser within the purchaser's state of residence. The purchaser is solely responsible for all shipping charges, insurance, receiving FFL transfer fees, taxes (if applicable), and any other costs associated with the transfer. Firearms and ammunition shall only be transferred to the successful registered bidder. No substitutions, third-party transfers, or transfers to another individual will be permitted except as required or allowed by applicable law. All FFL transfers for eligible local purchasers will be conducted at Landmark Realty & Auction, 306 LaDelle Ave., Dell Rapids, South Dakota, or another authorized FFL location designated by Landmark. All firearms and ammunition are sold AS IS, WHERE IS, WITH ALL FAULTS, with no warranties or guarantees of any kind, express or implied, including but not limited to any warranty of merchantability, fitness for a particular purpose, safety, operability, condition, authenticity, or suitability for use. Descriptions, photographs, and catalog information are provided solely as a convenience and are believed to be accurate but are not guaranteed. It is the purchaser's responsibility to inspect all items and determine their condition prior to bidding. Firearms are mechanical devices that may require inspection, cleaning, repair, or service by a qualified gunsmith prior to use. Landmark Realty & Auction makes no representation that any firearm is safe to fire or suitable for its intended purpose. To the fullest extent permitted by law, the purchaser assumes all risks associated with the purchase, ownership, possession, transfer, transportation, storage, handling, and use of any firearm or ammunition purchased. The purchaser agrees to release, indemnify, defend, and hold harmless Landmark Realty & Auction, its owners, officers, employees, agents, affiliates, contractors, consignors, and representatives from and against any and all claims, demands, causes of action, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses, including reasonable attorney's fees, arising out of or relating to the purchase, transfer, possession, ownership, storage, handling, transportation, use, misuse, discharge, malfunction, or condition of any firearm or ammunition purchased. By placing a bid on any firearm or ammunition, the bidder acknowledges that they have read, understand, and agree to all firearm-specific terms and conditions, all general auction terms and conditions, and all applicable federal, state, and local laws. The bidder further acknowledges that all sales are final, subject only to compliance with applicable firearms laws and transfer requirements.
